SURVEY REVEALS INCREASED RISK OF SQUATTING IN COMMERCIAL BUILDINGS
Following changes in the law late last year, which made squatting in residential properties a criminal offence, many predicted an increase in squatting in empty commercial buildings. Now a survey of facilities professionals by vacant property specialist SitexOrbis identifies that 30 per cent of respondents expect an increase in squatters targeting their properties, with 27 per cent saying that they have been targeted by squatters over the past two years.
From 1 September 2012, through Section 144 of the amended Legal Aid, Sentencing and Punishment of Offenders Act, squatting is criminalised for residential buildings (including social housing properties). People convicted under the act can be imprisoned for up to 51 weeks, or fined up to £5,000, or both. However, the act does not include an offence for squatting in a commercial or non-residential building, and this remains a civil offence.
Areas most at risk were identified as London (37 per cent), the south-east (22 per cent) and the Midlands (19 per cent), and many respondents also expressed concern about the threat of Travellers and Gypsies occupying their sites.
Options considered by respondents included video surveillance (57 per cent), alarm systems (55 per cent), manned guarding (43 per cent), perimeter fencing (38 per cent), warning signs (37 per cent), security boards or screens (33 per cent), temporary alarms (21 per cent), temporary video surveillance (8 per cent, live-in caretakers (8 per cent) and dog-handler patrols (8 per cent).
Benchmark - Risk UK's sister publication - recently published guidance for the creation of a layered solution to protect void properties. The articles observes, "Vacant properties have always been associated with a high level of risk, but in recent times this has increased exponentially. Arson, vandalism and fly-tipping have been issues for void properties, and to put this in context it is estimated that nearly half of the cases of fire damage to commercial buildings are arson-related. Also, as financial pressure increases for small tradespeople, the incidences of fly-tipping are on the rise. Whilst fly-tipping and graffiti may seem like annoyances rather than real risks, the costs of cleaning up after an incident are significant. Often, businesses are legally obliged to take action in a timely fashion.
"Squatting has been less of an issue for commercial sites, and when buildings are occupied it is often for illegal activities or events rather than as a residence. However, changes in the law relating to squatting in residential properties may well see this change. Either way, the costs – both financial and in terms of timespan – of regaining possession of a site and putting right any damage make an investment in some degree of protection cost-effective." – January 2013
